By downloading, installing, accessing, or using the BetCaddie mobile application for iPhone (the "App"), you ("User") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and ProTally Golf, LLC ("Company," "we," "us," or "our"), a Michigan limited liability company.
BetCaddie is a mathematical score-calculation tool — and nothing more. The App performs arithmetic operations on golf scores that Users manually enter. It applies the published rules of common golf game formats (e.g., Skins, Nassau, Best Ball) to those scores and displays calculated numerical outcomes. The App is functionally equivalent to a calculator, spreadsheet, or pencil-and-paper scorecard.
BetCaddie does not encourage, facilitate, enable, solicit, promote, or have any involvement whatsoever in gambling, wagering, betting, or the exchange of money, currency, cryptocurrency, property, or anything of monetary or non-monetary value between any persons, whether Users of the App or otherwise.
Without limiting the generality of the foregoing, BetCaddie expressly and unequivocally:
Dollar values and numerical labels displayed in the App are hypothetical calculation outputs only. Any dollar amounts, point values, or numerical figures shown in the App are mathematical outputs of user-configured parameters applied to user-entered scores. These figures are illustrative, hypothetical, and informational only. They do not represent actual debts, obligations, payables, receivables, or enforceable claims of any kind. The display of any numerical figure in the App shall not be construed as an encouragement, facilitation, or endorsement of any financial transaction between any persons.
Any exchange of money, goods, services, or anything of value between Users or any other persons — whether or not such exchange is related to, inspired by, or calculated using outcomes displayed in the App — is entirely outside the scope of the App, wholly independent of the Company, conducted solely at the discretion and risk of the individuals involved, and is expressly not facilitated, encouraged, endorsed, or enabled by the App or the Company in any way. The Company has no involvement in, knowledge of, control over, or liability for any such exchanges, and no feature of the App is designed to or intended to facilitate any such exchange.
By using the App, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction, if higher), that you have the legal capacity to enter into these Terms, and that your use of the App complies with all applicable laws in your jurisdiction.
You are solely and exclusively responsible for ensuring that your use of the App — and any actions you take outside the App that may be related to, inspired by, or informed by outcomes displayed in the App — comply with all applicable federal, state, local, tribal, and international laws, regulations, and ordinances, including without limitation any laws governing gambling, wagering, betting, contests, games of chance, games of skill, money transmission, and consumer protection in your jurisdiction.
By using the App, you represent, warrant, and acknowledge that:
The Company makes no representations whatsoever regarding the legality of any wagering, betting, or exchange of value — whether informal or otherwise — in any jurisdiction. The Company expressly disclaims any responsibility for, and shall have no liability arising from, any User's decision to engage in any such activity.
While we strive to implement correct golf scoring rules and game-scoring logic, BetCaddie is provided "as is" and we make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any scoring calculations, rule interpretations, or outcomes produced by the App.
Specific features — including but not limited to Skins, Greenies, Amigos, COD/Sixes, Nassau, Best Ball, and Wolf — may implement rules in ways that differ from house rules, regional customs, or formal golf association guidelines. Users should verify all calculations independently and agree upon rules before play.
The App is provided "as is" and "as available," without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, ProTally Golf, LLC expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement; any warranty that the App will be uninterrupted, error-free, or secure; and any warranty regarding the accuracy or reliability of any results, scores, or calculations generated by the App.
To the maximum extent permitted by law, ProTally Golf, LLC, its members, managers, employees, agents, and affiliates shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to:
In no event shall our total aggregate liability to you exceed fifty U.S. dollars ($50.00). In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless ProTally Golf, LLC and its members, managers, employees, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and litigation costs) arising from or related to: (a) your use of the App in violation of these Terms or any applicable law; (b) any dispute between you and another User or third party related to wagers, bets, exchanges of value, scores, or outcomes tracked or calculated in the App; (c) any claim by any governmental or regulatory authority that your activities related to the App constitute unlawful gambling, wagering, or betting; (d) any claim that the App was used to facilitate, operate, or participate in any gambling, wagering, or betting activity; or (e) your violation of any third party's rights.
You agree not to use BetCaddie to:
The App, including its design, code, content, branding (including the name "BetCaddie" and the "ProTally" marks), and all related intellectual property, are owned by ProTally Golf, LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the App, you agree to our data practices as described in the Privacy Policy.
The App and the BetCaddie website at betcaddiegolf.com use the following third-party services: (a) Google AdMob, which serves advertisements to non-subscribers using the Follow Round feature and may collect certain device-level information (such as your advertising identifier and IP address) in accordance with Google's Privacy Policy; (b) Apple, which processes all App purchases, subscriptions, and in-app purchases through the Apple App Store; (c) a third-party cloud infrastructure provider, which temporarily stores shared round data (player names and scores) to support the Match Code / Follow Round feature for up to 30 days; and (d) Mailchimp (operated by Intuit Inc.), which processes email addresses voluntarily submitted via the website's launch-notification signup form. Subscribers are not served advertisements inside the App. We are not responsible for the data practices of third-party services. See our Privacy Policy for more detail.
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without notice. We may also update these Terms at any time. The "Last Updated" date at the top of this page will reflect any changes. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Oakland County, Michigan. You agree to resolve any disputes with us on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions. These Terms, together with the Privacy Policy, constitute the entire agreement between you and ProTally Golf, LLC with respect to your use of the App.
